WALMART TO FIGHT OLD BIDDIES IN SUPREME COURT
April 8 2011
Washington, D.C. – There is no debating that the rights of women have improved dramatically in the last hundred years or so, particularly in western nations. Through suffrage and women’s lib, the fairer half of the species has made huge strides to
coming at least close to equality with men, at least as it applies in the workplace and society in general. It is possible however, that women and men will never achieve true equality in society even in the most liberal of societies, for the good or ill of society as a whole.
Whether that ongoing separation between the sexes is a result of some long held genetic prerogative or simply a result of socialized behaviours that have defined our species for millions of years is something that can and, will be, debated in perpetuity. Reasons and rationale aside however, many continue to fight against such discrimination, eschewing any notion of inheritance and trying to push society forward. That is, after all, the essential difference between humans and other animals, our ability to reject our nature and shape our world to our own liking. Such is the root of the effort by a group of women who have been pressing a class-action lawsuit against Walmart, claiming that the retail giant engaged in sex-based discrimination, claims the company believes are unwarranted and brought by a bunch of jealous old biddies.
“Walmart has repeatedly engaged in behaviours and practices, brought about by a corrupt corporate cultural, that stereotypes women which in turn leads to discrimination in pay and promotions. These decisions are informed by the values the company provides,” said lawyer for the plaintiffs. “It is very clear from the evidence we have collected that Walmart engages in this type of behaviour not as an anomaly but as a standard business practice. That these practices are simply the way the company does business across the country. That is why we are seeking compensation for our plaintiffs.”
The suit, which is seeking upwards of $25 billion for back pay and damages, is now being considered by the Supreme Court.
“Cases like this are notoriously hard to mount for a number of reasons. One of the key problems in a class-action case is that clear group of plaintiffs needs to be represented. That is, that all the parties need to agree on the claims and have absolutely zero disagreement. Otherwise you need a single case which is next to impossible to mount against a company this size,” said Scrape TV Legal analyst Gabe Hawthorne. “It’s also going to be a major challenge because of the makeup of the Supreme Court itself which only has three women and a bunch of guys who really aren’t into the whole lib thing. They have traditionally struck down all efforts at this kind of thing in the past, and I would bet that even with a record number of women on the bench the result will be the same. The cackling just isn’t loud enough.”
Walmart has understandably denied the claims, stating that the majority of incidents of discrimination are conducted by women executives, something to be expected.
“The reality is you need to prove that women are being specifically targeted as a gender. Even though it doesn’t really matter if they are being targeted by men or women, the argument will drown if Walmart can prove that it is other women doing the deed, because we all know how women can be with other women,” continued Hawthorne. “We’d like to believe that the law exists outside human interference and involvement but it is very much a human creation and therefore subject to the same rules as regular society. The truth is that women can be really nasty with other women and that is no different in the corporate world than it is in the real world, and they sure seem to complain a lot.”
Walmart apparently offered a settlement a number of years ago just to get the plaintiffs to shut up.
