WAR CRIMES TRIBUNAL CONSIDERING DISMISSAL AFTER MLADIC CLAIMS INNOCENCE
May 29 2011
Belgrade, Serbia – There are few who would argue that the break-up of Yugoslavia wasn’t the worst humanitarian disaster in Europe since the Second World War. For outsiders it’s a difficult thing to understand, but for the people of the region the
fracturing of that state and the ensuing ethnic slaughters were inevitable. Without the controlling hand of the Soviet Union, the manufactured nation was a powder keg, one which eventually exploded, spilling blood across the region and into the wider world.
By the time foreign powers became involved in the area tens of thousands had already been killed, something which occurred while most of the planet went on blissfully unaware of the conflict at all. Eventually though the scale of unfolding tragedy became apparent, leading to limited military interference and the Dayton accords, which only demurred the violence in the region. Now though, the region is largely peaceful and civil with those days a little more than a memory, but far less than a threat. With a new generation now alight in the region, closing the door on those harsh times is something most people in the new countries would like very much, and with the arrest of Ratko Mladic, the chief architect Srebrenica Massacre, many feel that day is coming. However, a new wrinkle has formed following the capture of Mladic, specifically claims by his son that he is innocent of the charges, prompting prosecutors in The Hague to re-examine their case.
“Whatever was done in Srebrenica, he has nothing to do with it. His orders were to evacuate the wounded, the women and the children and then the fighters. Whatever was done behind his back, he has nothing to do with that,” said Darko Mladic. “My father is also very ill and his health does not allow him to defend himself. He must be set free and clear of these charges, for the good of all honest and sensible people.”
Mladic, alongside Radovan Karadzic, is charged with multiple crimes related to the
Srebrenica incident and other ethnic crimes during the war.
“There were many crimes committed during the conflict, as often happens in war, but the massacre was flashpoint and something which could be articulated in a different way. It was a specific incident, one which could be catalogued and dissected and pursued. Had this incident not occurred it is entirely possible that Mladic would not have been on the run all these years, but it did happen,” said Scrape TV Legal analyst Gabe Hawthorne. “Crimes occur in war but this was exactly the right kind of ammunition to attack them with, something the ICC may not have had if this hadn’t occurred, and ultimately it could mean the end for them, no matter how fervently they protest their innocence. Even this testimony from family members may not be enough, particularly with so many people in the world calling for blood.”
Dozens of countries have officially lauded the arrest of Mladic. The European Union made Serbia’s entrance to the organization contingent on his arrest.
“This is not a well-liked guy. That unto itself could spell his doom. Whether it’s fair or
not, people who are well-liked are dealt with differently than people who aren’t so appreciated. Killing 8000 innocent people and burying them in mass graves tends damage your reputation with many people,” continued Hawthorne. “The bigger issue though is that the massacre was a global tragedy, and a preventable one, which the world failed to act upon. It is an embarrassment for the entire world really and they are going to want to save face, and that means someone is going to have to pay for it. The prosecutors may adapt their case in light of these claims of innocence, but I think it’s likely the trial will go forward whether or not they like it.”
Mladic’s granddaughter Anastazija also proclaimed his innocence.
